The NIS Directive will now need to be agreed with the EU’s Council of Ministers and may be adopted in 2015 along with the proposed EU data protection regulation. Together, The NIS Directive is applicable since May 2018 after it had been implemented in the Member States. Som en reaktion på utvecklingen antog EU NIS-direktivet (The Directive on Security of Network and Information Systems) under 2016, ett regelverk som omvandlas till nationella lagkrav hos samtliga medlemsstater. Member States had to transpose the NIS Directive into their national legislation by 9 May 2018 and identify operators of essential services (OES) by 9 November 2018. Under the NIS Directive, Member States are required to ensure that OES and digital service providers (DSP) implement cybersecurity requirements and report incidents. This Directive is without prejudice to the actions taken by Member States to safeguard their essential State functions, in particular to safeguard national security, including actions protecting information the disclosure of which Member States consider contrary to the essential interests of their security, and to maintain law and order, in particular to allow for the investigation, detection and prosecution of criminal offences.
